Martial law "courts" are the "courts" flying the yellow fringed flag. I put "courts" in quotes. They are really federal legislative tribunals.
What kind of court are you forced into?
Article 6. The Constitution is the supreme law of the land, and judges in every state shall be bound thereby.
Amendment 14 lower case c citizens are citizens "of the state wherein they reside"
Amendment 14, fifth section "The Congress shall have power to
enforce, by appropriate legislation, the provisions of this article."
Article 3 courts are established.
Article 2 legislative tribunals are constituted.
Your local state "courts" ARE federal tribunals. They do not get their jurisdiction from the state judicial power. "Courts" receive federal money for their federal duties.
Don't be confused just because legislative tribunals call themselves courts. They are "courts" that federal "Congress shall have power to enforce, by appropriate legislation, the provisions " of the 14th amendment. They are enforced in local state and federal courtrooms against 14th amendment citizens.
For more information read my book The Citizen Cannot Complain.
Proof of two jurisdictions:
The Supreme Court in the Cruikshank case, 92 US 542 at 551, was a case about the murderer of freed slaves after the Civil War:
"It is the natural consequence of a citizenship which owes allegiance to two sovereignties, and claims protection from both. The citizen cannot complain, because he has voluntarily submitted himself to such a form of government."
Also keep in mind that after the Civil War, the Supreme Court in Ex Parte Milligan, 71 US 2 said that civilian courts are available to protect their citizens from the federal government.
Some people have a difficulty in understanding the words in the Constituton.
Federal Congress writes laws to enforce the 14th Amendment (and all the other amendments that say congress enforces them, (13, 15, 18, 19, 23,24,26) even if they are contrary to State Constitutions.
And subject to the jurisdiction thereof. Subject to the Amendments that are enforced by Congress (13, 14, 15, 18, 19, 23, 24, 26) even if they are contrary to State Constitutions.
Use rock-solid proof from government documents to convince yourself that state judicial court must protect you from federal martial law courts: Read the US Supreme Court's decision in Ex Parte Mulligan, 71 US 2, and prove to yourself that the judicial branch of a sate government must protect its citizens from the federal military.
